A judge has decided that Kevin Federline will get custody of sons Sean Preston, 2, and Jayden James, 1, starting this Wednesday. At a hearing in the Federline v. Spears custody case in Los Angeles Monday, the court ordered that Federline take care of the children he shares with ex-wife Britney Spears until further order of the court.

Despite losing custody of her sons for the time being, the court specified that Spears must still adhere to the orders from a September 17th hearing, in which she was labeled a "habitual" user of controlled substances. Those orders include: attending counseling, meeting with a parenting coach and submitting to twice-weekly random drug tests.

Temporarily Loses Custody of Sons | Britney Spears
Britney Spears must hand over custody of her sons to Kevin Federline this week "until further notice of the court," a judge ruled Monday after a closed-door hearing.

L.A. Superior Court Commissioner Scott Gordon gave no reasons in his written decision, issued after lawyers met with him in a private session requested by Federline's lawyer. The ruling says that Federline gets custody starting Wednesday.

But the ruling came after the filing of misdemeanor charges against Spears – hit-and-run and driving without a valid California license – and claims by her ex-bodyguard that she used drugs and is a danger to her children, Sean Preston, 2, and Jayden James, 1.

Gordon also previously found that Spears is a "habitual, frequent and continuous" user of alcohol and controlled substances, and ordered her to submit to random twice-weekly testing.

Another hearing is set for Wednesday.

The singer, who has 50-50 custody with Federline, was seen around town with her children over the weekend, and on Sunday they had an early dinner at Taverna Tony in Malibu, as a crush of paparazzi camped outside.

"She seemed fine," the restaurant's owner, Tony Koursaris, says. "She was very comfortable having dinner here with her boys. ... The kids had a good time. Then we had to fight the paparazzi, of course."

The photographers, however, did come in handy for Spears at one point over the weekend. Around midnight Saturday, her Mercedes ran out of gas during a supermarket run. The photographers went to the gas station and helped Spears tank up her vehicle.

Britney Spears a pierdut custodia celor doi copii ai sai in favoarea fostului sot – Kevin Federline. Un judecator din Las Vegas a hotarat ca Sean Preston, in varsta de doi ani, si Jayden James – un an, sa fie crescuti de tatal lor – pana la stabilirea unei hotarari definitive.

Hotararea a fost luata la 10 zile dupa ce solista in varsta de 25 de ani a fost acuzata de parasirea locului accidentului dupa ce a intrat intr-un autoturism parcat. Daca va fi gasita vinovata, Britney ar putea fi condamnata la 6 luni de inchisoare.

Judecatorul a mai cerut ca atat Britney cat si Federline sa urmeze cursuri parentale. Cei doi s-au casatorit in octombrie 2004, insa au divortat anul trecut, in noiembrie.

Britney's on her way to getting her kids back by making sure all her bases are covered - first stop, the DMV! Queen B mugged for the camera today as she got her California driver's license just hours after handing off her kids to KFed's bodyguard as news came down that she had lost physical custody of her boys.

Brit was charged on September 21 with a hit-and-run and with driving without a license, so this is at least partial restitution.

After losing custody of her children, dropping them off with Kevin Federline, tanning, and going to the DMV, Britney Spears checked into Beverly Hills' Peninsula Hotel Monday night. Friend Sam Lufti was there with her and tells Usmagazine.com that she's feeling optimistic about regaining custody of sons Sean Preston, 2, and Jayden James, 1.

"She is doing OK," Lufti tells Us. "It has been a rough day. She is feeling very optimistic about the future."

A source close to Spears tells Us her optimism comes from the fact the Monday decision to give K-Fed custody was merely the result of some scheduling conflicts that kept Spears from taking her court-mandated drug tests. "There were scheduling conflicts and some errors in communication as to times and places for drug tests etc, but they're all squared away now," the source says, continuing, "Britney is hoping the judge will reverse the order Wednesday, now that she is making steps to follow through with what they asked."

Lufti has been taking care of the scheduling for Britney, another source tells Us. "Sam is arranging for Britney to take drug tests. He's arranging everything and getting it on track. Everyone is optimistic
that she'll get her kids back soon." Lufti also took Spears to the DMV yesterday to help her get a valid California license. "Sam is a really good friend of Britney's," the source tells Us. "He's a really good guy all around. She respects him."

Still, another friend of Spears' has a different story about the 25-year-old pop-star's mindset, telling Us, "She's so scared. It's her realest
moment ever.. She doesn't know what to do." The concerned friend adds, "She is going hit an all time low."
